Product Liability and Related Issues

Product liability remains an important issue faced by companies that manufacture or sell products. Warranty and other product related issues also create legal challenges. When necessary, we defend our clients in product liability litigation. We have considerable experience with claims involving natural gas, machinery, residential windows and doors, commercial glass construction, and HVAC equipment. We also have experience with fire cause and origin investigations and related claims.

However, we also assist clients in understanding their product liability risks and in their risk management and risk reduction efforts. We assist manufacturing companies in drafting their terms and conditions. Although terms and conditions cannot prevent third-party product liability and personal injury claims, they can establish who in the distribution chain will bear the ultimate risk. Terms and conditions can also define and minimize warranty-related risks.

Product liability risks are a particular concern for international companies considering entering the U.S. market. One of our shareholders has given seminars in conjunction with the International Handelskammer (chamber of commerce) in Munich, Germany, and the German American Chamber of Commerce in Atlanta regarding U.S. product liability law and risk management. We have considerable experience in explaining the U.S. legal system to international companies, and helping them deal with the legal challenges presented by the U.S. market.
